These Terms and Conditions ("Terms") govern your use of the Fintech Point POS SaaS platform ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms.


Subscription and Services

  • Access: We grant you a non-exclusive, non-transferable right to access the Service according to your selected subscription plan.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Modifications: We reserve the right to update features or functionality of the Service to improve user experience or security.


Fees and Payment

  • Billing: Subscription fees are billed in advance on a [Monthly/Annual] basis and are non-refundable unless otherwise stated.
  • Taxes: All fees are exclusive of VAT, sales tax, or other government levies unless specifically included.
  • Late Payments: Failure to pay subscription fees may result in temporary suspension or termination of your access to the Service.


Data Ownership and Privacy

  • Your Data: You retain all ownership rights to the business data (inventory, sales records, customer lists) you upload to the platform.
  • Our License: You grant us a license to host, back up, and process this data solely to provide the Service to you.
  • Security: We implement industry-standard security measures to protect your data; however, you acknowledge that no internet transmission is 100% secure.


Hardware Compatibility

  • Third-Party Hardware: While our software supports various barcode scanners, printers, and biometric devices (e.g., ZKTeco), Fintech Point is not responsible for hardware malfunctions or compatibility issues caused by third-party equipment.


Prohibited Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service for any illegal transactions or fraudulent activities.
  • Circumvent any technological measures or security features of the platform.


Uptime and Support

  • Service Level: We strive for [99.9%] uptime but do not guarantee that the Service will be uninterrupted or error-free.
  • Maintenance: We may perform scheduled maintenance, which will be communicated in advance whenever possible.


Limitation of Liability

To the maximum extent permitted by law, Fintech Point shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities arising from your use of the Service.


Termination

  • By You: You may cancel your subscription at any time through your account settings.
  • By Us: We may terminate your account for any material breach of these Terms, including non-payment.


Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mymensingh, Bangladesh.
